A car is often one of the first assets families need to deal with after a death. The answer depends on the title, any loan, state DMV rules, and whether the estate needs probate.
If there is a surviving joint owner or transfer-on-death beneficiary, the car may transfer outside probate. If the title was only in the deceased person's name, the DMV may require probate, letters of administration, or a small-estate vehicle form.

Start With How the Car Was Titled
- Joint owner: the surviving owner may be able to retitle the car with a death certificate.
- Transfer-on-death registration: some states allow a named beneficiary to claim the vehicle.
- Only the deceased person's name: probate or a small-estate process may be needed.
- Leased vehicle: contact the leasing company before moving or returning it.
If There Is a Loan
The loan does not disappear. The lender has a lien on the car. The estate, co-borrower, or inheriting person must usually pay off, refinance, sell, or surrender the vehicle according to the loan terms.
